By checking the acceptance box and proceeding, you authorize Excelia Compliance Group LLC d/b/a FDA Filings to act as your administrative U.S. Agent under these legally binding terms:
1. Strict Communications Limitation: Our role is strictly limited to an administrative communication link between the FDA and your facility per 21 CFR § 1.227. We rely entirely on the information you provide. We do not provide legal defense, regulatory consulting, or representation in enforcement actions.
2. Mandatory Response & Data Accuracy: The Client warrants all submitted data is accurate, truthful, and current. You bear sole responsibility for responding to all forwarded FDA communications. You must notify us within 10 business days of any updates to your facility info, address, or ownership status.
3. Non-Refundable Subscription Fees: All fees paid for upfront initial setups or annual tracking packages are 100% non-refundable and cover only the specific facility listed. Your ongoing annual subscription will automatically renew via Stripe until explicitly canceled.
4. Cancellation & FURLS Registry Withdrawal Policy: Upon service cancellation, subscription termination, or payment failure, the Client is strictly required to promptly appoint a new U.S. Agent within the FDA portal. If you fail to supply a valid new agent before your active term expires, we will log into your FURLS account profile and execute a “Withdraw as U.S. Agent” command. You explicitly acknowledge that because a foreign facility cannot legally maintain a blank U.S. Agent field, our administrative withdrawal will cause the FDA to instantly place your facility registration into an inactive status, immediately invalidating or canceling your Food Facility Registration.

Client shall NOT list our company name on product labels, packaging, or marketing materials. We hold zero specific knowledge of your products and assume no liability for product safety, fines, or border rejections.
6. Full Indemnification: The Client agrees to assume all operational risks and completely indemnify, defend, and hold harmless Excelia Compliance Group LLC against any federal fines, legal costs, or commercial losses resulting from your facility’s failure to respond to the FDA or providing inaccurate datasets.
